The Fifth District Court of Appeal held that our client’s son’s claim was for general negligence, and not medical malpractice. Thus, our client’s trial attorney did not need to comply with the often onerous pre-suit and evidentiary requirements for a medical malpractice claim.
The case can now proceed in the trial court, where our client will be able to seek justice for the defendant’s failure to protect our client’s son from tragically committing suicide while under the defendant’s care.
