In this case, the Plaintiff alleged that the Defendants, a medical center and one of its bus drivers, failed to help a patient who had visibly gone unconscious while on the medical center’s courtesy bus. The patient died shortly after the bus ride. The Plaintiff sought leave to pursue punitive damages against the Defendants, and the trial court allowed it. The Defendants sought certiorari review in the appellate court, raising a host of procedural and evidentiary arguments.
The Third District rejected all of the Defendants’ evidentiary arguments as outside of the scope of review on certiorari proceedings, and held that the trial court properly complied with the procedural requirements of the punitive damages statute. The Plaintiff’s case will now proceed in earnest in pursuit of justice.
